Agreement to Apple's Standard EULA

These Terms of Use supplement Apple's Standard Licensed Application End User License Agreement ("Apple EULA"). By using Insights Journal, you agree to both Apple's standard terms and these additional terms.

Where these terms conflict with Apple's Standard EULA, these terms shall prevail to the extent permitted by law.

Auto-Renewable Subscription Terms

Subscription Tiers

• Monthly Premium: $3.99 per month
• Annual Premium: $34.99 per year (save 26% compared to monthly)

Free Trial

• 7-day free trial available for new subscribers on both tiers
• Trial automatically converts to paid subscription unless canceled before trial ends
• Cancel anytime during trial with no charge

Auto-Renewal

• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Renewal occurs at the then-current subscription rate

Payment

• Payment is charged to your Apple ID account at confirmation of purchase
• All subscriptions are managed through your Apple ID account settings

Cancellation

• Cancel anytime via: iOS Settings → [Your Name] → Subscriptions → Insights Journal
• Cancellation takes effect at the end of the current billing period
• You retain access until the current period ends
• No partial refunds for unused time in the current period

Refunds

• Refund requests are handled by Apple, not by Insights Journal
• Contact Apple Support for refund inquiries
• Refunds are granted at Apple's sole discretion per their refund policy

Price Changes

• We may change subscription prices at any time
• You will be notified at least 30 days before any price increase
• Continued use after price change constitutes acceptance of new pricing
• You may cancel if you do not agree to new pricing

Health Data Use and Medical Disclaimer

HealthKit Integration

• The app reads sleep analysis, workout data, heart rate, and other health metrics from Apple HealthKit
• Health data is used solely for creating automated journal entries and tracking personal wellness patterns
• All HealthKit data processing happens locally on your device
• We do not share your HealthKit data with third parties

No Medical Use

• Do not use this app to make medical decisions
• Do not use this app in medical emergencies
• For medical emergencies, call 911 or your local emergency services immediately
• This app has not been evaluated by the FDA or any medical regulatory authority

Consult Healthcare Professionals

• Always seek advice from qualified healthcare professionals for any medical concerns
• Inform your doctor about any health changes or symptoms you experience
• Do not delay seeking medical care based on information or insights from this app

Data Accuracy

• Health data visualizations and insights are for informational purposes only
• Data may contain errors, omissions, or inaccuracies
• We make no guarantees about the accuracy or completeness of health data

Individual Responsibility

You are solely responsible for your health decisions. You assume all risks associated with using health-related features of this app.

Artificial Intelligence and Generated Content

AI Processing

• Your journal content is processed by OpenAI's API to provide insights, themes, tags, and chat responses
• Content sent to OpenAI is anonymized (no personal identifiers, health data, or location information included)
• OpenAI processes content temporarily and does not permanently store it

AI Accuracy Disclaimer

• AI-generated insights, tags, themes, and chat responses may contain errors, inaccuracies, or inappropriate content
• AI technology can "hallucinate" or produce plausible-sounding but incorrect information
• Do not rely on AI-generated content for important life, health, or financial decisions

No Guarantees

• We make no warranties about the accuracy, completeness, or reliability of AI-generated content
• AI insights are for reflection and journaling purposes only
• AI content is not intended as factual statements or professional advice of any kind

User Responsibility

• You are solely responsible for evaluating and acting on AI-generated content
• You assume all risks associated with using AI features
• Always apply critical thinking to AI suggestions and insights

Third-Party AI Service

• OpenAI processes content according to their terms of service: OpenAI Terms of Use
• We are not responsible for OpenAI's data handling or service availability

Content Ownership

• You retain full ownership of all journal entries and personal content you create
• AI-generated tags, insights, and themes become part of your personal journal
• You may delete any AI-generated content at any time

Data Collection and Privacy

Local Storage

• All journal entries are stored locally on your device in encrypted format
• We do not store your journal content on our servers or in the cloud
• You maintain complete control over your data

AI Processing

• Journal text is sent to OpenAI for AI features (insights, chat, themes)
• Content is anonymized before transmission
• OpenAI does not permanently store your content after processing

No Cloud Backup

• We do not provide cloud backup or synchronization services
• Your data exists only on your device
• You are responsible for backing up important journal entries

Privacy Policy

Full privacy details are available in our Privacy Policy, which is incorporated by reference into these Terms.

Data Deletion

• Delete all journal data anytime via app Settings
• Deletion is permanent and cannot be undone
• Deleted data cannot be recovered

Account Deletion

• You may permanently delete your account and all associated data at any time via the app Settings
• Account deletion removes all your data from our servers and your device
• Account deletion is permanent and cannot be undone
• Deleted accounts and data cannot be recovered after deletion

Ownership and License

App Ownership

• Insights Journal app, including all code, design, graphics, and documentation, is owned by the developer
• The app is protected by copyright, trademark, and other intellectual property laws

Your License

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the app
• License is for personal, non-commercial use only
• License terminates if you violate these Terms

Restrictions

• You may not copy, modify, distribute, sell, or lease the app
• You may not reverse engineer, decompile, or disassemble the app
• You may not remove copyright or proprietary notices from the app
• You may not use the app for commercial purposes

Trademarks

• "Insights Journal" and associated logos are trademarks
• You may not use our trademarks without prior written permission

User Content Ownership

• You retain all ownership rights to your journal entries and personal content
• You grant us no rights to your journal content
• Your content is yours and remains private

Limitation of Liability and Warranties

EXCLUDED DAMAGES

We shall NOT be liable for any:

• Personal injury, illness, or death
• Health-related claims or medical outcomes
• Decisions made based on app content or AI-generated insights
• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Emotional distress or mental anguish
• Issues arising from third-party services (OpenAI, Apple HealthKit)
• Inaccuracies or errors in AI-generated content
• Data loss or corruption
• Service interruptions or downtime

AS-IS BASIS

• The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including:
  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability
  • Uninterrupted or error-free operation

ESSENTIAL PROVISIONS

• These liability limitations are fundamental to our agreement
• The app would not be provided without these limitations
• If any limitation is found unenforceable, it shall be limited to the minimum extent required by law

JURISDICTIONAL VARIATIONS

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Account Termination and Effect

Termination by You

• Cancel your subscription anytime via iOS Settings → Subscriptions
• Access to premium features ends at the end of the current billing period
• Free features remain accessible after cancellation

Termination by Us

• We may terminate your access for violation of these Terms
• We may suspend or terminate service at any time with reasonable notice
• Termination for cause: no refund
• Termination without cause: pro-rated refund at our sole discretion

Effect of Termination

• All premium subscription features are immediately disabled
• Your journal data remains on your device (we do not delete it)
• You may export journal data before or after termination
• No refunds for unused portion of subscription unless required by law

Survival

Sections on Liability, Intellectual Property, and Dispute Resolution survive termination. Your obligations under these Terms survive termination.

General Provisions

Governing Law

• These Terms are governed by the laws of California, USA
• Without regard to conflict of law principles
• UN Convention on Contracts for the International Sale of Goods does not apply

Dispute Resolution

• Any disputes shall be resolved through binding arbitration or small claims court
• Arbitration shall be conducted by a neutral arbiter in California
• You waive your right to jury trial and class action participation
• Either party may seek injunctive relief in court for intellectual property violations

Changes to Terms

• We may modify these Terms at any time
• Material changes will be communicated via app notification or email
• Continued use after changes constitutes acceptance of updated Terms
• If you don't agree to changes, you must stop using the app and cancel your subscription

Entire Agreement

• These Terms, our Privacy Policy, and Apple's Standard EULA constitute the entire agreement
• Supersedes all prior agreements or understandings
• Any conflicting terms in promotional materials do not apply

Severability

• If any provision is found invalid or unenforceable, the remainder remains in effect
• Invalid provisions will be modified to the minimum extent necessary to be enforceable

Waiver

• Our failure to enforce any provision is not a waiver of our right to enforce it later
• Waiver of one violation is not a waiver of subsequent violations

Assignment

• You may not assign these Terms to anyone else
• We may assign these Terms in connection with a merger, acquisition, or sale of assets

Force Majeure

• We are not liable for delays or failures due to events beyond our reasonable control
• This includes: natural disasters, wars, pandemics, government actions, network outages
